Switzerland Quotas for Croatia : Potential Unilateral Reactivation of Quotas for Croatian Workers Under Bilateral Framework in 2026

On 26 November 2025, the Federal Council announced that it may activate the safeguard clause under the Agreement on the Free Movement of Persons (AFMP) if immigration from Croatia exceeds defined thresholds by 31 December 2025.

📌 Activation thresholds (trigger levels):

  • 2,004 B permits

  • 1,116 L permits

If either threshold is reached or exceeded, Switzerland may activate the clause.

 

For this year and as of end-October 2025 to status of used quotas is as follows:

  • B permits issued: 1,492

  • L permits issued: 656

A final decision will be taken in January 2026, once full-year data is available. SIL will monitor and proactively inform clients in case Quotas are to be applied and expected in 2026.


⏳ Final window

To be noted that 2026 is the last year in which this safeguard clause can be applied under the AFMP. From 1st January 2027, Croatian nationals will benefit from full free movement rights, aligned with other EU citizens under Switzerland’s bilateral framework.


🔍 Impact for employers

Depending on the outcome:

  • Hiring may continue as normal, or

  • Quotas may limit access to new permits, requiring planning and prioritisation. Timing and anticipation will be key since quotas would be allocated on a first come, first served basis.
